MBR AXIS Pty Ltd (ACN 661 895 487 ) (we, us or our), understands that protecting your personal information is important. This Privacy Policy sets out our commitment to protecting the privacy of personal information provided to us, or collected by us, when interacting with you.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information. The Australian Privacy Principles apply to personal information, that is, information or an opinion (whether true or not) relating to an identified individual or which can be used to reasonably identify that individual. Please note that information about companies is not personal information. However, the principles will apply to an individual who is carrying on a business as a sole trader.

What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include: names, addresses, date of birth, email addresses, phone number and Tax File Numbers. This Personal Information is obtained in many ways including interviews, correspondence, transactions, appointments, via our website, by email, media, publications, publicly available sources, and from third parties.

We may collect and hold personal information in both hard copy and electronic formats. We engage third parties to host electronic information through third party data servers.  

We don’t guarantee website links or policy of authorised third parties. We collect your Personal Information for the primary purpose of providing our services to you and providing information to our clients. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Extent of information collected 
We do not collect any personal information other than information reasonably necessary for, or directly relating to, the primary purpose for which we have been engaged or may be engaged, or for other functions and activities. 

Collection of extraneous or excessive information will be destroyed and/or deleted as soon as it is reasonably practicable to do so.  

When you provide us with someone else’s personal information, you should only do so with their authority or consent, or if you are required or authorised by law. You should also refer them to this Privacy Policy.

For tax clients, tax file numbers:

• can be collected by tax agents and accountants;

• can be used only to conduct client’s affairs; and

• can be disclosed only to client and the Australian Tax Office.

Direct Marketing

We may use your personal information to send you information about our services that may be of interest to you. You may opt out of receiving marketing communication at any time by contacting us using the contact us details on this website. We do not sell or rent personal information to third parties for marketing purposes.

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information will be used by us only:

• For the primary purpose for which it was obtained

• For a secondary purpose that is directly related to the primary purpose

• With your consent; or where required or authorised by law.

Sensitive information is a subset of personal information that is given a higher level of protection under the Australian Privacy Principles. Our policy is that we attempt not to collect sensitive information about our clients or prospective clients, however that may not always be possible. If any of our clients or prospective clients elects to provide us with any sensitive personal information, we will take all reasonable steps to ensure that the sensitive information is securely protected. In the event we propose to use such personal information, we will first notify you and seek your consent prior to such use. 

Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Disclosure of Personal Information

Your Personal Information may be disclosed in a number of circumstances including the following:

• Third parties where you consent to the use or disclosure;

• Where required or authorised by law; and

• As part of our business.

This means that we may disclose personal information to:

Overseas Disclosure

We store your personal information in Australia. Where we disclose your personal information to third parties, those third parties may store, transfer or access personal information outside of Australia. We will only disclose your personal information overseas in accordance with Australian Privacy Principles.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure. While we are committed to security, we cannot guarantee the security of any information that is transmitted to or by us over the Internet. The transmission and exchange of information is carried out at your own risk.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information.

We are committed to ensuring that the personal information we collect is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the personal information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure. 

We cannot guarantee the security of any information that is transmitted to or by us over the Internet. The transmission and exchange of information is carried out at your own risk. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that the personal information we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy. 

Access to your Personal Information

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing. MBR AXIS Pty Ltd will not charge any fee for your access request. In order to protect your Personal Information we may require identification from you before releasing the requested information. Maintaining the Quality of your Personal Information It is important to us that your Personal Information is up to date.

We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.
